Terms of Service
These Terms of Service ("Terms") govern your access to and use of the HobbyDeal websites, mobile applications, software, tools, data, and related services (collectively, the "Services") provided by Hobby Holdings LLC, a Maryland limited liability company doing business as HobbyDeal ("Hobby Holdings LLC," "HobbyDeal," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
Hobby Holdings LLC is organized under the laws of the State of Maryland and operates from its principal place of business in Maryland, USA. In these Terms, references to Hobby Holdings LLC or HobbyDeal include our affiliates and subsidiaries where appropriate. "You" refers to the individual or entity accessing the Services, as well as any electronic agent acting on their behalf. Our processing of personal data is described in our Privacy Policy.
1. Changes to These Terms
We may update these Terms and related policies (including FAQs and guidelines) from time to time. When we do, we will post the updated version and revise the “Last updated” date above. Changes take effect on the date they are posted unless otherwise stated. Your continued use of the Services after an update constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Services and, if applicable, cancel your account.
The version of the Terms posted at the time you access the Services governs that access. We may, at our discretion, refuse or suspend access to the Services if we believe you are in breach of these Terms or for any other reasonable business reason. If you are not in breach, we will provide notice before terminating access.
2. About the HobbyDeal Marketplace
HobbyDeal operates a live marketplace where third‑party users can list, discover, and trade collectibles and consumer goods. HobbyDeal facilitates transactions between users but is not the trader, buyer, seller, or owner of items listed by users. Prices are set by users and may differ from retail or estimated values. Any valuations shown in the Services are estimates only and are not guarantees of trade prices.
The Services are intended for individuals 18 years of age or older. If you are under 18, you must have permission from a parent or legal guardian to use the Services.
We may investigate complaints and violations of these Terms and, where permitted by law, take appropriate action, including suspending accounts. We may share information with law enforcement or advisors as required by law and our Privacy Policy. HobbyDeal is not responsible for items alleged to be stolen or unlawfully acquired prior to listing or after delivery.
3. Accounts, Passwords, and Security
To list or trade, you must create an account and maintain a valid payment method with our payment processors. You agree to provide accurate information and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify HobbyDeal immediately of any unauthorized access or suspected breach. You may not use another user's account without permission, and you may not transfer or assign your account.
4. Fees, Promotions, and Taxes
Fees for using the Services, including shipping fees where applicable, are described in our FAQs and may change from time to time. We may issue promotional or discount codes subject to applicable terms. Sellers are responsible for collecting and remitting any taxes due on their transactions unless HobbyDeal is required by law to act as a marketplace facilitator. You agree to provide accurate tax information as needed to comply with legal obligations.
5. Authentication; Shipping and Handling
HobbyDeal does not grade or authenticate items. Any inspection performed by us is limited and does not guarantee authenticity, condition, or labeling accuracy by third‑ party graders. We are not liable for counterfeit items, mislabeling by third parties, or damage due to improper packaging. Additional details and requirements are outlined in our FAQs.
6. Seller Obligations
By accepting an offer, you agree to deliver the exact item for the agreed price and to ship it using the carrier and within the timeframe specified in the sale confirmation. You must ship from the country associated with your account address and retain proof of shipment. You are responsible for the accuracy of your listings and inventory.
Failure to fulfill orders may result in actions including, without limitation:
- Service fees or penalties (e.g., a minimum fee or a percentage of transaction value)
- Removal of listings or cancellation of pending offers
- Withholding of payouts until disputes are resolved
- Retention of fees and reimbursement of costs incurred to remedy issues
- Temporary or permanent account suspension
7. Refunds and Cancellations
Certain charges related to cancellations or violations of these Terms are not refundable. If you do not recognize a charge, you generally have 7 days to contact HobbyDeal or initiate a dispute with your payment provider, subject to applicable law and the payment provider's rules. Review the FAQs for details on fees and timelines.
8. Common Dispute Scenarios
- Non‑refundability of penalties for failure to ship: if you fail to send an item you agreed to deliver, penalties assessed under these Terms are generally not refundable.
- Cash components in trades may be non‑refundable if an item is not shipped, as described in our FAQs and fee policies.
- Once an item is delivered and signed for, HobbyDeal is typically not responsible for subsequent issues. Post‑delivery disputes are handled under applicable law and the policies in effect at the time of the transaction.
Disputes will be resolved using the resolution process described below.
9. Vault Services
HobbyDeal may offer optional vaulting services for storage and trading of eligible items. By using vault services, you confirm you own the items and have the right to transfer them. We will verify items based on provided details where feasible; if an item is not as described, we may hold it while we work with you to resolve the issue or return it per our policies. Vaulted transactions typically result in instant ownership transfer once both parties agree.
Fees for vault services are listed on the platform and may be updated. We may retain items as payment for unpaid fees or damages arising from violations of these Terms, as permitted by law. While we use commercially reasonable security and maintain insurance appropriate to our operations, we do not guarantee against all loss. Payouts for covered claims, if any, are limited as described in our policies.

- You agree to indemnify HobbyDeal for claims arising from your breach or violations of law
10. Disclaimers and Limitation of Liability
The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, HobbyDeal disclaims all warranties, and HobbyDeal’s total liability for claims arising out of or related to the Services is limited to amounts paid to HobbyDeal for the transaction(s) giving rise to the claim within the 30 days preceding the event.
11. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Informal Resolution
Before filing a claim, you agree to contact us at support@hobbydeal.app to attempt to resolve the dispute informally. We will attempt to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 60 days of submission, you or HobbyDeal may bring a formal proceeding.
Binding Arbitration
If we cannot resolve a dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
The arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, or by JAMS under its Streamlined Arbitration Rules and Procedures, as applicable. The AAA Rules and JAMS Rules are available online or by calling the respective organization. Payment of all filing, administration, and arbitrator fees will be governed by the applicable arbitration rules, unless otherwise stated in these Terms.
Class Action Waiver
YOU AND HOBBYDEAL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR CONSOLIDATED ACTION OR PROCEEDING. Unless both you and HobbyDeal agree otherwise, the arbitrator may not consolidate or join more than one person's or party's claims and may not otherwise preside over any form of a consolidated, representative, or class proceeding.
Arbitration Location and Governing Law
The arbitration will be conducted in the county where you reside or in another mutually agreed location. These Terms and any dispute arising out of or related to them or the Service will be governed by the laws of the State of Maryland, without regard to conflict of law principles. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision.
Exceptions to Arbitration
Either party may seek equitable relief in court for infringement or other misuse of intellectual property rights (such as trademarks, trade dress, domain names, trade secrets, copyrights, and patents). Additionally, either party may bring a claim in small claims court if it qualifies.
Opt-Out Right
You have the right to opt out of binding arbitration within 30 days of first accepting these Terms by sending written notice to HobbyDeal at support@hobbydeal.app with the subject line "Arbitration Opt-Out." The notice must include your name, address, and a clear statement that you wish to opt out of this arbitration agreement. If you opt out, all other parts of these Terms will continue to apply.
Severability
If any portion of this arbitration provision is found to be unenforceable or unlawful for any reason, the unenforceable or unlawful provision will be severed from these Terms, and severance will have no impact on the remainder of the arbitration provision or the parties' ability to compel arbitration of any remaining claims. If the class action waiver is found to be unenforceable, the entire arbitration provision (but not the rest of these Terms) will be null and void.
12. Indemnification
You agree to indemnify, defend, and hold harmless HobbyDeal, its affiliates, and their respective officers, directors, employees, agents, and representatives from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any rights of another party, including other users; (d) your User Content; or (e) any transaction or dispute between you and another user. We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.
13. Intellectual Property
The Services and all content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by HobbyDeal, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:
- Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
- You may store files that are automatically cached by your web browser for display enhancement purposes
- You may print or download one copy of a reasonable number of pages of the Services for your own personal, non-commercial use
If you believe any content on the Services infringes your copyright, please contact us at support@hobbydeal.app with a detailed description of the alleged infringement.
14. User Content and Conduct
You retain ownership of any content you submit, post, or display on or through the Services ("User Content"). By submitting User Content, you grant HobbyDeal a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Services and HobbyDeal's business.
You represent and warrant that:
- You own or have the necessary rights to submit the User Content
- Your User Content does not violate any third-party rights
- Your User Content complies with these Terms and applicable laws
We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, at our sole discretion.
15. Termination
We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease. You may terminate your account at any time by following the account deletion process described in our Privacy Policy.
All provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
16. Miscellaneous
Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and HobbyDeal regarding the Services and supersede all prior agreements and understandings, whether written or oral.
Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
Waiver
No waiver of any term of these Terms will be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms does not constitute a waiver of such right or provision.
Assignment
You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without our prior written consent. We may assign these Terms at any time without notice to you.
Force Majeure
HobbyDeal will not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
Export Controls
You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce. You represent that you are not located in, under the control of, or a national or resident of any country to which the United States has embargoed goods.
Electronic Communications
By using the Services, you consent to receive electronic communications from us. These communications may include notices about your account and information concerning or related to the Services. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.
Third-Party Links and Services
The Services may contain links to third-party websites or services that are not owned or controlled by HobbyDeal. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that HobbyDeal is not responsible or liable for any damage or loss caused by your use of any such third-party content, goods, or services.
